The Non-Habitual Resident regime was wound back by the 2024 State Budget. A short transitional window then expired. What remains in mid-2026 is not a quiet copy of the old NHR. It is a narrower scientific-research and innovation incentive, plus ordinary Portuguese tax residence for everyone else. Families who still plan a move as if 2019 rules were on the table will underwrite a regime that no longer accepts them.

This article is general information, not a tax opinion and not a residency mandate. Eligibility, deadlines, and the treatment of foreign income depend on facts, on Autoridade Tributária practice, and on counsel who can read the Portuguese return with the family’s other residences. Vellum is a fee-only multi-family office: the family pays for the map, not for a relocation product.

What the NHR rewind actually ended

Portugal’s original NHR (regime fiscal do residente não habitual) was a ten-year personal-income-tax status for new tax residents who had not been Portuguese tax residents in the prior five years. It became a magnet for families who wanted a European base with preferential treatment of certain foreign income and, for some years, a special rate on high-value Portuguese activity. That design is what closed to new applicants.

The 2024 State Budget, Lei n.º 82/2023 of 29 December, is the legislative rewind. New NHR registrations stopped as the replacement framework took over. A transitional path existed for people who had already begun a residency process or who met specified 2023-linked conditions, with a last window that ran to 31 March 2025. By June 2026 that window is history. Autoridade Tributária still maintains an NHR frequently asked questions page because grandfathered files remain live. A FAQ is not an invitation to apply as a newcomer.

People who obtained NHR on time generally keep the remainder of their ten-year clock, subject to remaining Portuguese tax resident in the relevant years and to the activity rules that applied to their vintage. That grandfathering is the only “old NHR” that still works. It is not portable to a spouse who arrives in 2026, and it does not reset because the family bought a second house in Cascais.

Portugal NHR 2026 families: what still exists

Two live paths remain. The first is IFICI, the incentivo fiscal à investigação científica e inovação, created in article 58.º-A of the Estatuto dos Benefícios Fiscais. The second is ordinary residence: becoming a Portuguese tax resident under the Código do IRS and paying tax under the general rules, with treaty relief where a convention applies. Everything else in the 2026 conversation is either grandfathered NHR, a visa that is not a tax regime, or marketing that conflates the three.

IFICI is not a rebranded NHR for passive families. Autoridade Tributária’s IFICI FAQ states the gate in plain language: the person must not have been tax resident in Portugal in the previous five years, must become Portuguese tax resident, must exercise a qualifying activity listed in article 58.º-A, and must not benefit or have benefited from NHR, from the article 12.º-A IRS option, or from IFICI before. Former NHR beneficiaries are out. That single exclusion is why a family that used NHR in the 2010s cannot treat IFICI as a second round.

Cross-border families already comparing jurisdictions should put Portugal on the same desk as other residence files, not on a souvenir list. Vellum’s live note on global tax residency shifts in 2026 is the wider map. Portugal is one corridor. It is not a substitute for a French, Swiss, or Gulf analysis.

IFICI: a talent incentive, not a wealth wrapper

Article 58.º-A is published in the tax-code collection on the Portal das Finanças page for EBF 58.º-A. The official FAQ, which families should read before any brochure, describes how qualifying Portuguese-source category A and B income tied to the listed activity can be taxed at a special 20% IRS rate, while other Portuguese-source categories follow the general IRS rules. Foreign-source income is, as a general rule, exempt, with important exceptions: category H, and income paid from territories on Portugal’s clearly more favourable tax-regime list, which the FAQ illustrates with a 35% rate in the worked Dubai-dividend example. Those figures are Autoridade Tributária’s own presentation of the statute. This article does not invent 2026 brackets, surcharges, or municipal rates beyond that official description.

The activity test is the real gate. Routes include teaching and scientific research (Fundação para a Ciência e a Tecnologia), contractual investment-linked roles (AICEP), highly qualified professions in listed companies (AT, under Portaria n.º 352/2024/1 of 23 December), roles in activities recognised as relevant to the national economy (AICEP or IAPMEI), SIFIDE-linked research staff (ANI), and roles in certified startups (Startup Portugal), plus regional routes for the Azores and Madeira. Several routes require an employment contract for a “posto de trabalho.” Autoridade Tributária has said that a services contract with an AICEP-recognised entity is not enough where the statute requires a job post, and that a mere shareholder of a unipessoal company does not qualify, though a managing partner as a board member may. Families who planned to “put the founder on a services invoice” are reading a different law.

Deadlines the brochure skips

Registration runs through Portal das Finanças. The official FAQ states that the request should be filed by 15 January of the year after Portuguese tax residence begins. Late registration does not restart a fresh ten years: the incentive runs for the remaining legal period from the year of filing. Status information is made available by 31 March. Beneficiaries must report loss of conditions, or a change of employer or competent body, by 15 January of the following year. The ten-year clock does not reset when the person changes company. Proof of the filing may allow 20% withholding on qualifying A or B pay: that is a payroll instruction, not a substitute for the annual return. Documents must be kept for ten years. This is an audited, substance-based regime. A paperwork title without the activity will not survive the year-by-year test in article 58.º-A, n.º 3, which requires the person to keep earning income in a listed activity.

Ordinary residence: the path most families actually get

If IFICI does not apply, Portugal still works as a country of residence. It does not work as a preferential wrapper. A person who is Portuguese tax resident under the Código do IRS is in the ordinary system: worldwide income, general IRS rates, and treaty relief according to the relevant convention. This article will not invent those general rates for 2026. They belong on the return and on the Portal das Finanças, not in a family-office slogan.

Ordinary residence still has planning content. Treaty tie-breakers, the 183-day and habitual-abode tests, the location of the family foyer, and the source of dividends, rents, and gains decide whether Portugal is an addition to a French IFI map or a replacement of another residence. A Golden Visa, a D7, or a digital-nomad visa is an immigration status. It is not IFICI and it is not NHR. Mixing the three is how families discover, after the move, that they are ordinary residents with a Portuguese tax number and a worldwide return.

French-resident families who keep Portuguese property, or who split the year, still need an IFI and succession overlay. Portuguese bricks can enter a French IFI inventory for a French resident. Transmission follows a different statute. The live Vellum inventory of IFI in 2026 and the note on inheritance tax rules by country in 2026 belong on the same desk as the Portuguese residence memo. Buying a Lisbon flat does not create IFICI. Leaving France does not erase French exit-tax or IFI questions by itself.

What a family office should refuse to assume

Refuse the assumption that “Portugal is still NHR if we hire a local accountant.” New arrivals in 2026 are IFICI or ordinary. Refuse the assumption that foreign dividends are always exempt under IFICI: black-list source countries follow a different charging rule in the official FAQ. Refuse the assumption that a holding company in Dubai plus a Portuguese personal residence recreates the old NHR. Refuse the assumption that a spouse, a child, or a family-office employee automatically piggybacks on the founder’s status. Each person has a residence test and, for IFICI, an activity test.

Refuse also the inverse panic: that Portugal is “closed.” It is not. It is selective. A university researcher, a certified-startup operator, or a highly qualified professional in a listed industrial or technology activity may still have a coherent 10-year IFICI file. A retired rentier generally will not. The honest 2026 sentence is that Portugal remains a European jurisdiction with treaties, a functioning tax administration, and a talent incentive. It is no longer a broad preferential regime for new wealthy arrivals.

Implementation sits with Portuguese counsel and with the family’s other advisors, coordinated without a product to sell. The Vellum services map is where residence, holdings, and reporting are kept as one file. How that differs from a private-bank relocation package is described in Vellum versus traditional wealth-management firms.

Conclusion

Portugal NHR 2026 families should treat the old regime as grandfathering, not as a product still on the shelf. New arrivals face IFICI, a 10-year scientific-research and innovation incentive with a 20% special rate on qualifying Portuguese A and B income as Autoridade Tributária describes it, or ordinary IRS residence. Former NHR beneficiaries cannot enter IFICI. Deadlines, activity routes, and black-list income rules sit on official Portal das Finanças pages, not in a dinner-table rate. Families who want Portugal for climate, time zone, or operating companies can still move. Families who wanted the 2010s brochure need a different jurisdiction, or an ordinary-residence model they can actually live with.

Discretion. Stability.
